These Terms and Conditions (“Terms and Conditions”) govern the relationship between Morris Travel Co. LLC (“Morris Travel Co. LLC,” “MTC,” or “we/us/our”) and you, the purchaser or traveler (“Client” or “passenger” or “you/your”). By planning travel with MTC, you agree to be bound by these Terms and acknowledge that MTC acts solely as a booking agent for disclosed principal suppliers, including tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation providers, boat purveyors, and other independent contractors providing accommodations, transportation, and other services (“Supplier(s)”). MTC is not the source or provider of the travel services. These Terms include warranties, disclaimers, and exclusions of liability, which may restrict your rights and remedies while providing protection to MTC.

1. USE OF MTC SERVICES, ACCESS, AND INFORMATION FOR TRAVEL BOOKINGS

You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and make travel bookings with MTC. You agree to be financially responsible for all travel bookings you make with us, whether for yourself or other members of your traveling party. You warrant that all information provided on your behalf or on behalf of others is true and accurate. You agree to make only legitimate reservations or purchases with MTC and its Suppliers. Any speculative, false, or fraudulent reservation is prohibited.

MTC accepts all bookings solely as the booking agent for the travel Suppliers on your itinerary. Separate Supplier terms and conditions apply to your reservation, and by booking through MTC, you agree to the booking terms of each Supplier on your itinerary. You also agree to abide by the terms imposed by any Supplier selected for your travel.

MTC is not responsible for arrangements made independently of MTC, including any costs or fees incurred for independently booked airline, hotel, excursion, or travel protection services. If you make your own flight arrangements, MTC is not responsible for any loss resulting from cancellations, schedule changes, or delays and cannot assist with rescheduling. Frequent flyer or other loyalty points may not be earned on reservations booked through MTC, and hotel and airline rewards may not be redeemable.

2.  RIGHT TO CORRECT ERRORS AND OFFERS SUBJECT TO AVAILABILITY

MTC reserves the right to correct any errors. In the event of pricing errors or omissions, we may adjust pricing or make other corrections. All offers, incentives, and Supplier promotions are subject to availability and may change without notice. Clients are advised to confirm reservations well in advance to avoid fare increases or additional late booking fees.

3. SERVICE FEES

MTC charges a non-refundable service fee for professional travel planning, research, consultation, itinerary design, booking, and ongoing support services. This fee is separate from the cost of travel components, including but not limited to airfare, accommodations, cruises, tours, travel protection, and other Supplier-provided services.

Service fees are due before any research or planning begins, unless otherwise stated in writing. Payment of the service fee constitutes acceptance of these Terms and authorizes MTC to begin work on your behalf.

Service fees compensate MTC for time, expertise, and services rendered and are not contingent upon the final booking of travel.

Service fees are non-refundable under all circumstances, including but not limited to cancellation of travel, changes to travel plans, denial of travel documentation, or Supplier-related issues.

MTC reserves the right to apply additional fees for revisions, changes, or new planning requests that extend beyond the original scope of work.

4.  PAYMENTS, CANCELLATIONS, AND CHANGES TO BOOKINGS

You are responsible for all charges, fees, duties, taxes, and assessments arising from your travel bookings. By submitting a credit card authorization, you allow MTC to purchase travel products from Suppliers on your behalf. Except in cases of fraud, you agree not to dispute a payment with your bank or credit card company to circumvent these Terms or Supplier booking terms. Any attempt to chargeback, reverse, or recollect a payment may result in MTC collecting additional costs, fees, and expenses, including attorney fees.

Payments are due according to each Supplier’s terms. Failure to make payment or comply with Supplier conditions may result in cancellation, denial of access to travel services, or forfeiture of payments. In some cases, no refund is available once a booking is made. All cancellation requests must be submitted in writing. Cancellation penalties from MTC and third-party Suppliers will apply. Any changes to bookings may incur increases in costs or fees from Suppliers or MTC. Certain bookings cannot be changed, and refunds for unused portions of travel may not be available.

5. TRAVEL DOCUMENTS, INCLUDING TSA AND DHS IDENTIFICATION REQUIREMENTS

Clients are responsible for obtaining and carrying valid passports, visas, and other documents required by applicable government regulations. Passport cards are not accepted for most international travel. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and the U.S. Department of Homeland Security (DHS) require acceptable identification to board flights. Acceptable IDs include DHS-designated enhanced driver’s licenses, U.S. passports, or foreign passports.

Some countries will not admit passengers if their passports expire within six months of return. Non-U.S. citizens may require additional documentation, and you must notify MTC if traveling on a non-U.S. passport. MTC does not control or guarantee visa issuance. If a visa is denied, MTC is not responsible for lost payments. Children and infants may also require travel documents, including parental or guardian consent forms. The names, dates of birth, and gender on identification must exactly match booking records. Discrepancies may result in denied boarding or missed travel connections.

Upon receiving travel documents, you must review and verify all information for accuracy. Contact MTC immediately if corrections are needed. If you do not notify us within 24 hours of receipt, MTC bears no responsibility for additional costs of corrections.

6. INDIVIDUAL ENTRY AND EXIT REQUIREMENTS

Each country has its own rules regarding travelers with past or current criminal offenses. If you have any criminal record, you are responsible for contacting the destination country directly to verify entry and exit requirements. You may also refer to the U.S. State Department website at https://travel.state.gov for further information. MTC does not inquire about an individual’s criminal record to respect client privacy. For example, if traveling to or through Canada, individuals with a Driving While Intoxicated (DWI) record or unpaid child support judgments should review current entry requirements at https://www.canada.ca.

7. IMMUNIZATIONS AND HEALTH SCREENINGS

You must obtain required immunizations and health screenings before travel. MTC is not responsible for accuracy of health requirements at departure or arrival. Required inoculations may need to be recorded by your health practitioner on a valid vaccination certificate. Check with your health practitioner before booking and refer to the State Department (http://travel.state.gov) and CDC (http://wwwnc.cdc.gov/travel/) for destination-specific information.

8. RISKS AND SAFETY

Travel may involve greater risk depending on the destination. Clients should monitor news and review U.S. Government travel advisories. Information on health and safety conditions is available at http://www.state.gov, http://www.tsa.gov, http://www.dot.gov, http://www.faa.gov, http://www.cdc.gov, and http://www.cbp.gov. Participation in travel constitutes acceptance of these risks.

In emergent health or safety situations, MTC may, at its sole discretion, modify itineraries or cancel trips.

9. HAZARDOUS MATERIALS

Federal law prohibits passengers from bringing hazardous materials aboard aircraft. Violations can result in imprisonment and fines. Hazardous materials include explosives, compressed gases, flammable items, oxidizers, poisons, corrosives, and radioactive materials. Small quantities of medicinal and toilet articles are exceptions. Clients should contact their airline for clarification and review prohibited items at http://www.tsa.gov/traveler-information/prohibited-items.

10. AIR TRAVEL, SCHEDULE RECONFIRMATION, AND CHECK-IN

Airline tickets are contracts between the passenger and the airline. MTC does not control airline operations and is not liable for delays, cancellations, luggage fees, or policies. MTC acts solely as a booking agent and is not the Merchant of Record. Refunds and changes must come directly from the airline. Airline e-tickets typically expire one year from issuance unless otherwise specified.

Check in at least 2 hours before domestic flights and 3 hours before international flights. Reconfirm flight times at least 24 hours prior for domestic flights and 72 hours for international flights. Frequent flyer mile accrual and seat assignments are at the airline’s discretion.

11. LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE

MTC acts solely as a booking agent for independent Suppliers and does not control their operations. Suppliers may alter itineraries for reasons including severe weather. MTC is not liable for personal injury, property damage, or other losses arising from Supplier services. Your recovery from MTC is limited to the commission and fees actually received.

12. FORCE MAJEURE

MTC will not be in breach of these Terms or otherwise liable for any failure or delay in performing an obligation due to causes beyond its reasonable control, including but not limited to acts of God, accidents, riots, war, terrorist acts, epidemics, pandemics, quarantine, civil commotion, breakdown of communications (including web host or internet provider), equipment malfunction, destruction of or serious damage to facilities, natural catastrophes (such as extreme weather events, floods, volcanic eruptions), governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosions, generalized lack of availability of raw materials or energy, or any other unforeseen circumstance beyond MTC’s control. The purchase of travel insurance is highly recommended on all trips.

In addition, MTC’s Suppliers include Force Majeure provisions in their own terms. If a Force Majeure event occurs, Suppliers may vary, postpone, or cancel any itinerary or arrangement at their sole discretion. Any refund due to non-performance is at the Supplier’s discretion, though MTC will use reasonable efforts to secure reimbursement for you where possible.

13. CLIENT CONDUCT

Each participant on a trip escorted by MTC is expected to act responsibly and follow behavior guidelines established by MTC and its Suppliers, including dress codes at religious or cultural sites or Supplier-specific requirements. MTC and its Suppliers reserve the right to remove you from any facility, hotel, resort, tour location, or means of transportation if your health or conduct endangers yourself or others, disrupts other clients, or interferes with operations or security. No refund will be given in such cases.

When booking with MTC, you accept responsibility for any damage or loss caused. Full payment for damages (reasonably estimated if unknown) must be paid directly to the accommodation owner, manager, or Supplier. You must indemnify MTC for the full amount of any claim, including legal costs. MTC is not responsible for costs incurred if a guest is removed from a trip or portion of a trip. Baggage and personal effects remain the sole responsibility of the participant.

Transportation, possession, or use of illegal drugs will result in immediate termination of your trip and possible prosecution. You are responsible for complying with licensing laws for prescription and over-the-counter drugs in all countries visited. Some laws require carrying a doctor’s prescription.

14. CURRENCY FLUCTUATIONS

Prices are subject to change based on currency exchange rates. MTC is not responsible for foreign transaction fees.

15. TRAVEL INSURANCE

MTC offers access to travel insurance to protect passengers and their investment in travel. Unless specifically noted, travel insurance is not included in the itinerary cost and protects against third-party Supplier default/bankruptcy, delays, interruptions, missed cruise connections, cancellations, medical emergencies (transportation, evacuation, repatriation), lost or delayed baggage, illness, job loss, changes of plans, accidental death and disability, and travel accident/sickness medical expenses. Proper insurance may protect you from financial loss in almost all circumstances.

Without insurance, cancellations or interruptions may result in loss of monies up to the full cost of travel bookings, with MTC and Supplier cancellation penalties applying. Travel insurance is not required to purchase other MTC products or services, but declining insurance may require an insurance waiver.

MTC is not a licensed insurance broker. Our advisors cannot answer technical questions about benefits, exclusions, or conditions, or evaluate adequacy of existing coverage. Additional charges apply for travel insurance. You are responsible for understanding your coverage and arranging alternative coverage for excluded conditions. MTC cannot guarantee claim approval under any policy or the extent of coverage.

16. RESERVATIONS OF RIGHTS AND CHANGES TO THESE TERMS

MTC may change these Terms at any time. Updated versions will be posted on our website and take effect immediately.

17. GENERAL

These Terms are governed by the laws of the State of Kentucky. You agree to the exclusive jurisdiction and venue of the state and federal courts in Gallatin County, Kentucky, for any disputes arising from travel bookings with MTC. Claims must be submitted in writing within twelve (12) months after trip completion; claims not submitted within this period are deemed waived. MTC is not liable for damages other than actual compensatory damages, and you waive the right to seek punitive, exemplary, incidental, or consequential damages. Claims must be brought individually, not as part of a class, collective, or representative action.

If any provision is deemed invalid or unenforceable under applicable law, it will be replaced by a valid provision reflecting the original intent, and the remainder of the agreement continues in effect. These Terms, including referenced conditions, constitute the entire agreement between the Client and MTC, superseding prior communications or proposals. Printed or electronic versions of this agreement are admissible in judicial or administrative proceedings as business records.
